What are the allegations in the complaint? The complaint alleges that the documents filed in connection with the IPO contained materially false and/or misleading statements and/or failed to disclose that: (1) Funko’s earnings growth trends were not as strong as suggested; (2) Funko’s EBITDA growth trend was not representative of its prospects; and (3) as a result, Funko’s Registration Statement and Prospectus were materially misleading at all relevant times. When the true details entered the market, the lawsuit claims that investors suffered damages. Based upon the foregoing, the complaint charges defendants with violations of the Securities Act of 1933.
